Be-MUSIC – online sound archives and the intellectual property rights

Databases are fundamental cornerstones for research and understanding in the field of musical traditions. The Be-Music project will bring together the digitized music collections (photos instrument, field photos, records, and sound recordings) housed at the Royal Museum for Central Africa (RMCA) in Tervuren and the Brussels Museum of Musical Instruments (RMAH-MIM) into a new, multi-lingual information platform for musical heritage.
One of the major challenges facing scientific institutions when putting intangible collections online is to establish good practice in terms of current law and ethics. The sound archives preserved in Belgium represent the musical heritage of the former Belgian colonies, the legitimacy of which in terms of ownership or representation is regularly contested.
In this presentation, we will address the methodological issues of copyright and intellectual property of sound archives with a view to decolonisation processes, and the creation of a national platform using crowdsourcing tools. The aim is to question the notion of legal ownership of sound archives through the legal frameworks used by cultural institutions to put their collections online. We also want to look at the moral and/or emotional issues involved in (re)appropriating cultural heritage.

Queer jurisprudence in African courts: litigation beyond decriminalisation

In the decade of 2010, many African LGBTI human rights groups use strategic litigation as a tool of claiming their rights. In 2013, the case Eric Gitari, in Kenyan, and the LEGABIBO case in Botswana were groundbreaking for the strength of the LGBTI activism. The Ugandan High Court decision of August 2014, that declared the Anti-Homosexuality Act null and void, despite some flaws, represented the consolidation of a queer jurisprudence in the African continent. Many other cases were decided in different countries in the following years. The courts in Botswana (2019) and Namibia (2024) declared the unconstitutionality of the sodomy laws. Other courts decided on the rights of transgender people in different circumstances (as in Zambia, Zimbabwe and South Africa). What can we learn from these litigations across Africa? How are they shaping the law and politics of African countries? Is there an African corpus of African queer jurisprudence? To answer these questions, we aim to map the cases in court dealing with sexual orientation or gender identity issues. The objective is to identity trends in jurisprudence, underlying the outcome of the decisions, the argumentation of the judges and assess its impact in the politics of each country.

An Africanist Reading into Red Sea Geopolitics

In recent years, a lot has been written about the renewed interest of the Gulf States, Iran, Türkiye, China, and other non-African powers in the Red Sea region. Analysts agree that this interest has been driven by geopolitical, security, and economic considerations, and they have overwhelmingly argued that such competition among non-African powers has destabilizing effects in the African Red Sea littoral states and the wider Horn of Africa. These powers are seen to approach or interfere in the affairs of weaker African states and exacerbate political rivalries, violence, and armed conflict.

However, an Africanist reading into the Red Sea geopolitics reveals the importance of the agency of the Horn of Africa state and non-state actors in international affairs. Ancient and historical ties across the Red Sea and the Gulf of Aden have shaped the cultural, social, political, and economic reality on both sides. Although during and since the Cold War, the international relations analysis of the Red Sea geopolitics has emphasized the role great and regional powers, particularly the coastal state and non-state actors in the Horn of Africa have also played an important role in it. Their agency in political, security, and economic affairs has been significant, and in their local context paramount, to the understanding of the complex geopolitical reality in the Red Sea.

The proposed paper seeks to highlight the agency of the Horn of Africa state and non-state actors in the Red Sea affairs. It shows how these actors choose alignments and foreign partnerships based on pragmatic and transactional approaches and mainly seek to use them to improve their position in domestic political and economic competition. However, they also play a geopolitical role through the pursuit of their regional and international aspirations, interests, and objectives, because their actions have internationally significant outcomes.
